Ekosem-Agrar AG: Resolutions of the noteholders' meetings of 30/31 May 2022 can be executed

• Karlsruhe Higher Regional Court issues release order

Walldorf, 21 November 2022 – In the release proceedings initiated by Ekosem-Agrar AG the Karlsruhe Higher Regional Court has decreed in its release order (file no. 1 AktG 1/22) that the action of annulment against the resolutions of the noteholders' meeting of 31 May 2022 of ESA bond 2019/2024 (ISIN DE000A1R0RZ5), which is pending in court, does not prevent the execution of these resolutions. The Karlsruhe Higher Regional Court explained its decision in particular by stating that the action of annulment was obviously unfounded.

Thus, both the resolutions of the noteholders' meeting of ESA bond 2012/2022 (ISIN DE000A1MLSJ1) of 30 May 2022 and the resolutions of the noteholders' meeting of ESA bond 2019/2024 of 31 May 2022 can now be executed without undue delay. The resolved amendments to the respective terms and conditions of the bonds will then also become effective.
